Terms of Service

These terms apply to Cotokim on cotokim.com. When you create an account or buy the full plan, you accept them. They are short and describe what Cotokim does today.

Who we are

Cotokim is an online service run from Brazil. Write to us at contato@cotokim.com, our channel for questions, requests and complaints.

What Cotokim is

A planner for the clothes and essentials your baby needs, based on the climate where you live and the month your baby is due, with a baby shower page. The list, the shower page and family sharing on the same list are free.

Your account

• You sign in with a code sent to your email, with no password. Keep access to your email safe.
• You can delete your account at any time, in My account.
• To buy the full plan, you must be an adult where you live. If you are not, a parent or guardian must make the purchase with you.

The lists and the tips

The quantities and tips come from public sources, such as the CDC, the National Institutes of Health, the Consumer Product Safety Commission and NHTSA, and from Cotokim's own estimates. Each page says where its numbers come from. They are for planning: for your baby's health, follow the advice of the professionals who care for you and your baby. These organizations do not review or endorse Cotokim.

The baby shower page

• You are responsible for what you write on your shower page and for the payment details you add to receive cash gifts.
• Cash gifts go straight from your guests to you, through PayPal or Venmo, as you choose. Cotokim does not receive, hold or transfer that money.
• Your shower page never shows your phone number or your exact due date. The due month appears only if you choose to show it.
• Anyone with the link can see the page, including the cash gift details and the recipient name you add. You can change the link or pause the page at any time.

The full plan

• What it includes: the shopping list by size, the week-by-week plan until the birth and the budget.
• Price: $9.99 (U.S. dollars), a one-time payment for your family's list. It is the final price: nothing is added at checkout. It is not a subscription and it never renews.
• Before you pay, the screen shows the price and what the plan includes.
• How you pay: right here on our page, with a Visa or Mastercard card issued outside Brazil, in Stripe's secure payment form. Cotokim never sees your card number.
• The charge comes from Brazil, in U.S. dollars. Some banks charge a fee on purchases from a merchant outside the United States; check with yours.
• Free trial: when you build your list, you get 7 days to try the full plan, with no card. When the 7 days end, nothing is charged, and your list stays free and complete.
• Double payment: if the same plan is paid twice, the second payment is refunded automatically.
• If you delete the list and the baby's data, the plan stays with your family, and the parts that depend on your due date come back when you enter it again.

Cancel within 14 days

• You can cancel the purchase within 14 days. The window closes at 11:59 p.m. Eastern Time on the 14th day after your purchase, and My account shows that date.
• The person who made the purchase cancels it in My account, on the "Full plan" screen, with "Cancel my purchase", and confirms. We do not ask why.
• The refund is for the full amount, to the same card. We email you a receipt with the date and time. Banks usually show the refund within 5 to 10 business days.
• When you cancel, the full plan is removed. Your list stays free and complete.
• If the button is not there and you are still within the 14 days, or if you cannot sign in, write to contato@cotokim.com from the email of your account and we cancel the purchase for you.

Nothing in these terms limits the rights that the consumer protection law of your state gives you.

Proper use

Do not use Cotokim for anything illegal or to deceive gift givers. A shower page or an account that does so may be paused or closed.

Responsibility

We are responsible for the content we publish. If you find an error, write to us: we check it against the source and correct it. To the extent the law allows, our total liability to you for any claim about Cotokim is limited to the amount you paid for the full plan. This limit does not apply where the law of your state does not allow it, and it does not apply to gross negligence or willful misconduct.

Changes to these terms

If we change these terms, we publish the new version on this page with its date, and we tell account holders in the app or by email before a material change applies. Your purchase is governed by the terms in force on the day you paid. The date of this version is the "Updated on" date at the end of this page.

Your data

How we handle your personal information is in the Privacy Policy and, for health data such as your due date, in the Consumer Health Data Privacy Policy.

Questions and complaints

Write to contato@cotokim.com and we reply by email. You can also contact the consumer protection office of your state attorney general or the Federal Trade Commission.

Under California Civil Code section 1789.3, California residents can contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by phone at (800) 952-5210.

Governing law and courts

These terms are governed by the laws of the U.S. state where you live, including its consumer protection laws. You may bring a claim in the courts of the county where you live, including small claims court.
